Australian Expat

Australian Expat Taxation requirements for Thailand.

Starting in 2024, Thailand has updated its tax laws for expats, including Australians living in the country. The most significant change is that foreign-sourced income transferred to Thailand will now be taxed, regardless of when the income was earned. Previously, only income brought into Thailand within the same tax year it was earned was taxable.

Timeframes

Expats who spend more than 180 days per year in Thailand are considered tax residents and must follow these new regulations.

Income Sources

For Australians residing in Thailand, this means that income from sources like investments or rental properties transferred into Thailand will be subject to Thai personal income tax.

Australian (DTA)

Australians may still claim tax credits under the Thailand-Australia Double Taxation Agreement (DTA) to avoid being taxed twice.

What risks could you face?

As an expat in Thailand, failing to register as a tax resident and neglecting to file a tax return can expose you to several risks:

Fines and Penalties: The Thai Revenue Department imposes monetary fines and interest on overdue taxes. In cases of prolonged non-compliance or evasion, the penalties can escalate significantly.
Legal Action: Non-compliance with tax regulations may result in legal action, including tax fraud charges. This could lead to severe fines, criminal prosecution, and, in serious cases, imprisonment.
Immigration Issues: Your tax status is linked to your visa and residency status. Failing to register as a tax resident or file returns could impact visa renewals or work permits, potentially jeopardizing your legal stay in Thailand.
Double Taxation: Without proper tax residency status, you risk losing benefits under the Thailand-Australia Double Taxation Agreement. This could lead to being taxed in both countries without access to relief.
Financial Reputation: Non-compliance can damage your standing with financial institutions, affecting your ability to secure loans or maintain accounts, as tax compliance is often required for financial services.
Water damage from plumbing, water heater, heating or cooling system or appliance.
